FORT LAUDERDALE, FL (February 2, 2026) Today, AIDS Healthcare Foundation (AHF) will file a public records act lawsuit to obtain files from the Florida Department of Health (DOH) to ascertain details regarding the undocumented $120 million budget shortfall which has resulted in proposed cuts to the AIDS Drug Assistance Program (ADAP), starting March 1, 2026, which will negatively impact over 16,000 Floridians living with HIV/AIDS, losing their life-saving medications and access to care.

Today’s lawsuit follows an initial petition filed by the organization with Florida’s Division of Administrative Hearings over rules that the state’s Department of Health (DOH) illegally enacted, which will cut off access to lifesaving HIV medications for 16,000 Floridians.
In its petition, filed last Tuesday, January 27, 2026, in Tallahassee, AHF asserted the state’s Department of Health illegally changed rules regarding income eligibility thresholds for its AIDS Drug Assistance Program (ADAP), without having gone through the mandatory rulemaking process.
AHF has been granted an expedited hearing scheduled for February 18, 2026, on the petition, with a final ruling to be issued on February 27, 2026.
